RIGHTS TO THE WORK

The artist, having taken the initiative in creating it, remains the owner of the copyright to their creation, within the meaning of French law. The rights to perform and reproduce the works featured on the mayam.uk website belong to their authors and to MAYAM. Their joint authorization is required for any exploitation of these rights.

INTELLECTUAL PROPERTY RIGHTS

All elements present on the website and the website itself are protected by copyright, trademark law, design law, and/or any other intellectual property law. By elements, we mean, but are not limited to: photographs, images, drawings, illustrations, texts, videos, logos, trademarks, models, software, etc. These elements belong to MAYAM or are used with the consent of their owners. As such, any reproduction, representation, use, adaptation, modification, incorporation, translation, marketing, partial or complete by any process and on any medium whatsoever (paper, digital, etc.) is prohibited without the prior written authorization of MAYAM, except for the exceptions referred to in Article L 122.5 of the Intellectual Property Code, under penalty of constituting an offense of infringement of copyright and/or designs and models and/or trademark, punishable by two years' imprisonment and a fine of €152,449.02.

PERSONAL DATA

The automated processing of personal information has been declared to the French National Commission for Information Technology and Civil Liberties. Pursuant to the French Data Protection Act of January 6, 1978, you have the right to access, modify, rectify, and delete your personal data. DATA SECURITY

Information you provide to www.mayam.uk is stored on the secure servers of our Open Resources hosting provider (excluding banking information). Access to this information is protected and limited to the recording and processing of your orders, as well as statistical operations that allow us to improve our services, such as sending newsletters, photo alerts, recommending to a friend, or sponsoring. When you pay for an order on www.mayam.uk, you enter your bank details directly on the secure Revolut server. Your bank details are encrypted (SSL, Secure Socket Layer technology). They do not circulate unencrypted over the internet and cannot be intercepted. MAYAM does not have access to your bank details.

COOKIES

Cookies are a text file sent by our website to your browser and stored on your computer. The mayam.uk website uses cookies in two ways: - to facilitate your login to your customer account by automatically recognizing you. This is only possible if you have indicated your wish by checking the corresponding box. - to allow you to retrieve the contents of your shopping cart up to 90 days after your visit to our website. - to improve and personalize website features such as wishlists or visual preferences. If you do not accept these cookies, some or all of these services may not function properly. - to capture visitor information to identify bugs and improve performance, thus streamlining the browsing experience. They help us identify the slowest pages, images, and animations and correct bugs and technical issues when visitors browse the website. Payment data is never collected. If you do not accept these cookies, we will not be informed of your visit to our site. The cookie only takes into account your actions on Mayam.uk. It does not allow us to know the other sites you have visited or will visit. You have the option to delete your cookies. However, each time you visit Mayam.uk, a new cookie will be set.

Terms of Use

ARTICLE 1. SCOPE OF APPLICATION

The general terms and conditions of sale detailed below (here in after referred to as the "General Terms and Conditions") govern the contractual relationship between any user of the Mayam.uk website (here in after referred to as a "User" or "You") and the MAYAM brand.

These general terms and conditions of sale are the only ones applicable and replace all other conditions, unless prior, express and written exemption. MAYAM may occasionally be required to modify certain provisions of its general terms and conditions, so it is necessary that these are reread before each visit to the MAYAM site (hereinafter referred to as the "Site"). These modifications are binding from the date they are posted online (the date of posting appearing at the end of these conditions) and cannot apply to contracts concluded previously. Each purchase on the Site is governed by the general terms and conditions applicable on the date of the order. By validating your order, you unreservedly accept the General Terms and Conditions after having read them. By accessing the Site, you agree to comply with these conditions. It is specified that these conditions govern the sales of MAYAM photographs and frames on the Site. These conditions apply to the exclusion of all other conditions, in particular those in force for sales in MAYAM Galleries (here in after referred to as the "Galleries") or in stores distributing MAYAM photographs.

ARTICLE 2. USE OF THE SITE

To use the Site, you must be at least 18 years old, legally capable of entering into a contract, and use this Site in accordance with these Terms and Conditions. You guarantee the truthfulness and accuracy of the information you provide on this Site. MAYAM reserves the right to cancel or refuse any order from a customer with whom it has a payment dispute regarding a previous order.

The Site is available in French and English. The language of the Site depends on the language of your internet browser. If your internet browser language is not one of the two languages ​​above, the language of the Site will be French. You can change your language selection on the Site's homepage.

1) Essential Product Characteristics

The products sold on the Site are limited edition numbered art photographs, frames. The photographs are in one or more formats and media, depending on the agreements between the photographer or their representatives and MAYAM. The photographs are accompanied by a biography of the artist and a certificate of authenticity in English.

Only one certificate is accepted per order. The certificate cannot be used for multiple orders; it must be used at a single time. Any remaining balance cannot be credited. Gift certificates are non-exchangeable and non-refundable.

Prices are inclusive of all taxes, excluding shipping costs. Payments are accepted only in euros. In the case of delivery to a country other than metropolitan France, you are the importer of the work(s) concerned. For all works shipped outside the European Union and French overseas territories, customs duties or other local taxes, import duties, or state taxes may be payable.

These fees and amounts are not the responsibility of MAYAM. They will be your responsibility and are your sole responsibility, both in terms of declarations and payments to the competent authorities and organizations in your country. We advise you to inquire about these matters with your local authorities.

MAYAM reserves the right to modify its prices at any time. Works will be invoiced based on the rates in effect at the time orders are placed, subject to availability. Works remain the property of MAYAM until full payment of the indicated price.

2) Placing an Order

To place an order, you must complete at least the following steps:

• View the photo sheet. On this screen, you can choose the format and media from those offered for this photo. The stock status is indicated (in stock / available in a few days / pre-order available within 1 month / sold out). You must click "Add to Cart" to add this item to your cart.

• "Cart" screen: you can delete an item or modify the ordered quantities.

• Login screen or customer account creation screens.

Delivery method selection screen. This screen provides a link to modify the items in your order.

• Summary and payment selection screen. This screen allows you to choose your payment method and check the various elements of your order (items, quantity, delivery method, total price). You must ensure that all of these elements comply with your request. Using the links on this screen, you can modify your order.

• You must then accept these general terms and conditions of sale and use of the Site to proceed to the payment step. The terms and conditions are available for reading and printing via the link titled "General Terms and Conditions of Sale." Acceptance is confirmed by checking the box next to the link to these terms and conditions. The general terms and conditions of sale and use of the Site must be accepted with each order.

• You pay for your order using the chosen payment method.

• The contract is concluded upon confirmation of payment by the bank.

• The Site will send you an email confirmation of your order within a few minutes.

) Payment Methods

You can pay for your order on the Website using several payment methods:

• Credit card, virtual credit card, Visa, Mastercard.

• Bank transfer (orders from the European Union only)

4) Payment Security

For credit card payments, the transaction is processed by "Revolut," the payment system of the bank "Revolut." The User's banking data is encrypted (SSL, Secure Socket Layer technology). It does not circulate unencrypted over the internet and cannot be intercepted. Your banking data (card number, expiration date, etc.) is not shared with MAYAM.

5) Proof

The data recorded by the Site constitutes proof of all transactions between the Site and its customers. The data recorded by the payment system constitutes proof of financial transactions.

6) Delivery

Order Processing

Orders placed before midnight (Paris time, GMT+1 hour), Sunday through Monday, excluding public holidays, are shipped the next day (for photographs marked "in stock"). In other cases, orders are shipped the evening of the following business day. All ordered works are shipped in a single order.

Works marked "available in X days" will be shipped within X days on average. Works marked "sold out" or "out of stock" can no longer be ordered.

Delivery Address

Mayam delivers to mainland France and 24 countries (Germany, Belgium, Cyprus, Czech Republic, Denmark, Estonia, Finland, Greece, Hungary, Ireland, Italy, Latvia, Lithuania, Luxembourg, Malta, Netherlands, Poland, Portugal, Slovakia, Slovenia, Spain, Sweden, and the United Kingdom). Delivery to other countries: upon request.

Delivery will be made to the delivery address you confirmed when ordering as the "delivery address." This address may be different from the "billing address."

Changing the delivery address after placing an order is often not possible for logistical reasons. However, you can contact us if you wish to change your delivery address; we will consider the options based on your order.

Delivery Methods and Delivery Times

Possible delivery methods depend on the quantity, size of the item(s) ordered, and the delivery country. If your order includes items of different sizes, the size of the largest item will be taken into account. Mayam reserves the right to choose the carrier.

The delivery date depends on stock status, the order shipment date, and the delivery time induced by the delivery method.

Estimated delivery times are two (2) to six (6) business days (excluding Saturdays, Sundays, and public holidays) from the date the Delivery Email is sent.

For products not marked "in stock", from receipt of the order, payment and preparation of the product until delivery will be made within 13 (13) working days (excluding Saturdays, Sundays and public holidays). The time may be slightly longer when the products must be delivered to areas with difficult access. We will make our best efforts to deliver the ordered products within the time indicated in the Delivery Email. For Deliveries to a delivery point, an email or SMS will be sent to you as soon as your package arrives at the delivery point of your choice. From the day of delivery, you can collect the package upon presentation of an identity document.

Although we make every effort to deliver your products within the timeframes defined above, delivery dates are estimates only, are not guaranteed, and cannot be relied upon against us. However, a maximum delivery time of thirty (30) days from the date of receipt of the Delivery Email is guaranteed.

For orders with in-store delivery, the customer has four months after being notified of the availability of their order to collect it. Otherwise, the order will be canceled, and any amounts previously paid will be retained by the supplier as compensation. After this period, the customer will not be entitled to a refund or return of the goods.

Shipping Costs

Shipping costs vary depending on the country and delivery method, as well as the number and format of artworks ordered. Details of shipping costs are available by following this link.

By creating your account, you agree to the MAYAM Account Terms and Conditions. Shipping is not allow from an other not registered company.

Receiving Delivery

Upon receiving your order, it is your responsibility to open the package to inspect the condition of the photographs or frames. If you are not personally receiving the package, ask the person in charge of receiving it to do this. In the event of a problem, please hand your package over to the delivery person (La Poste or private carrier), stating the problem, and contact our customer service the same day.

Do not sign the delivery slip if the order arrives damaged. No claims will be accepted if the delivery slip is signed.

In the case of delivery by private carrier, the carrier is not required to deliver inside your home and may over the package to you at the entrance of your building or house.

We therefore recommend that you arrange for assistance to carry the package into your home.

Receipt of the transported items extinguishes any action against the carrier for damage or partial loss if, within three days, excluding public holidays, following the date of receipt, the recipient has not notified the carrier of their reasoned protest by extrajudicial act or registered letter (Article L 133.3 of the French Commercial Code).

The customer has a period of 4 months after being notified of the availability of their order to collect it. Otherwise, the order will be canceled and any amounts previously paid will be retained by the supplier as compensation. After this period, the customer will not be entitled to a refund or a return of the goods.

7) Right of withdrawal

In accordance with Article L221-18 of the French Consumer Code, you have the right of withdrawal to return any work that does not suit you. Return costs will be the sole responsibility of the customer. This right does not apply to gift card orders, orders placed by companies, or personalized orders produced specifically for the customer.

In the event of an order for products whose manufacture is carried out specifically, the Customer will not be able to request the cancellation of his order in accordance with Article L 221-28 of the Consumer Code, which excludes the possibility for the Customer to exercise his right of withdrawal. For orders of non-personalized photographs, you can use the model withdrawal form, but this is not mandatory.

8) Right of Return of products

If the artwork received does not match your order ;

You have the right to return it. In this case, please contact our customer service team, who will provide you with the return address and instructions.

MAYAM will exchange the damaged item, subject to availability. If an item is no longer available, MAYAM will offer you the option of choosing another item of the same value.

In the event that you exercise your right of return, and only in this case, the return and reshipping costs are borne by MAYAM.

ARTICLE 3. FORCE MAJEURE

Pursuant to Article 1148 of the French Civil Code, MAYAM shall not be liable or considered to have committed a fault in the processing of your file if any delay or non-performance results from a case of force majeure.

ARTICLE 4. PROTECTION OF PERSONAL DATA

Pursuant to Law No. 78-17 of January 6, 1978, as amended, relating to information technology, files, and civil liberties, and European Data Protection Regulation 2016/679 on the protection of individuals with regard to the processing of personal data and on the free movement of such data, mayam.uk informs the User of its commitment to respect the confidentiality, integrity, and security of the data that the user may communicate to it through the Site.

Any personal data that identifies you directly (including your first and last name, postal address, email address, and telephone number) or indirectly (including your computer traces left by your browsing on the Site) is considered confidential data and is treated as such, subject to changes in the legal framework governing the classification of personal data.

4.1. Processing of Data Relating to the Services

4.1.1 Processing

Subscribing to, accessing, and/or using certain Services involves the processing of personal data, which you agree to. The controller of users' personal data is referred to in Article 1.1 of these General Terms of Use.

MAYAM, the data controller whose registered office is aware of the trust you place in it by entrusting it with your informations.. MAYAM attaches the utmost importance to the confidentiality and security of this information.

As such, MAYAM undertakes to comply with this Privacy Policy, which you accept when you use its services.

4.1.2 Declaration of the Processing of Personal Information

The automated processing of personal information has been declared to the French National Commission for Information Technology and Civil Liberties under number 1280165.

By creating your account, you accept the MAYAM Account Terms and Conditions, you become a MAYAM Customer. If you did not object to the registration confirmation, you will receive information and commercial offers about MAYAM by email or text message. If you no longer wish to receive these notifications, you can change these preferences in your Customer Account on the Website or by writing to us at the address below.

Pursuant to the French Data Protection Act of January 6, 1978, you have the right to access, modify, rectify, and delete your personal data. You can exercise this right by sending us a letter to the following address: MAYAM, Customer Service.

You can also view or modify your personal data in your customer account at mayam.uk.

4.1.3 Targeted Advertising, Emails, and SMS

With your consent where required, MAYAM may use the data you provide for commercial prospecting purposes (for example, to send you our newsletters, send you invitations to our events, or any other communications that may be of interest to you, and display targeted advertisements on social media or third-party sites).

Regarding promotional or news emails: you may withdraw your consent at any time by clicking on the unsubscribe link provided in each of our emails or by contacting us as described in Section 4.3 below.

Regarding targeted advertising: on social media (e.g., Facebook, LinkedIn): you may object to this processing at any time by configuring the advertising settings in your account;

On third-party sites: you can refer to Section 4.4 below to understand how to withdraw your consent.

4.1.4 Legal Basis for Processing

Pursuant to Article 6.1 of the General Data Protection Regulation and the Terms of Use to which the user has agreed, the user is informed that the various processing operations of their data are necessary for the execution and fulfillment of contractual obligations arising from the services offered by the company.

4.1.5 Data Retention Period

Personal data will be deleted or archived one years after your last use of our portal or services.

This data may also be retained for a period of 10 years thereafter in the archive database, with restricted access, in order to comply with MAYAM's legal and regulatory obligations.

4.1.6 Data Recipients

MAYAM may also use information, including data, with MAYAM's carrier partners within the framework set out in this policy.

MAYAM only shares your data with the third parties mentioned in this article in the following cases:

- When we use a service provider to perform any contract entered into between you and us or to provide or improve our services;

- When MAYAM has a legal obligation to do so or if MAYAM believes in good faith that it is necessary to respond to any claim against it, comply with any legal request, or to protect the rights, property, and safety of MAYAM, its members, and, more generally, any third party.

In accordance with applicable law and with your consent where required, MAYAM may aggregate data about you and information collected through cookies.

4.2 Data Transfer

As a general rule, MAYAM stores personal data within the European Union.

However, to the extent that, for example, some of our service providers are located in countries outside the European Union ("Third Countries"), MAYAM transfers some of your personal data to Third Countries. This may particularly be the case to Third Countries for which the European Commission has not issued an "adequate protection" decision. In such cases, MAYAM ensures that this transfer is carried out in compliance with applicable regulations and guarantees a sufficient level of protection for the privacy and fundamental rights of the data subjects (in particular through the European Commission's standard contractual clauses).
